Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of https://tf-labs.com and any related webpages, content, features, products, and services operated by TF Labs LLC (collectively, the “Site”). In these Terms, “TF Labs,” “we,” “us,” and “our” refer to TF Labs LLC. “You” and “your” refer to the person accessing the Site or purchasing a product.

Please read these Terms carefully. By accessing the Site, creating an account, submitting an order, or otherwise using the Site, you agree to these Terms and to the policies incorporated into them. If you do not agree, do not use the Site or submit an order.

Nothing in these Terms limits any right or remedy that cannot lawfully be waived under applicable law.

1. Eligibility and Authority

You may browse the Site only in compliance with applicable law. To create an account or purchase a product, you must:

Be at least 18 years old;
Have the legal capacity to enter into a binding agreement; and
Use the Site for lawful personal or business purposes.

If you use the Site on behalf of a business or other organization, you represent that you are authorized to bind that organization to these Terms.

Products sold through the Site are intended for adults unless the applicable product label expressly states otherwise. Do not purchase a product for a minor unless use by that minor is expressly permitted by the product label and has been approved by an appropriate licensed healthcare professional.

If a product-specific disclosure or separate policy directly conflicts with a general provision in these Terms, the more specific disclosure or policy controls for that subject. Applicable law controls in every instance.

3. Dietary-Supplement and Health Information

TF Labs sells dietary supplements. Content on the Site—including product descriptions, ingredient information, research summaries, articles, graphics, customer reviews, and answers to frequently asked questions—is provided for general informational and commercial purposes. It is not medical advice and is not a substitute for diagnosis, treatment, or advice from a physician, pharmacist, registered dietitian, or other qualified healthcare professional.

Statements regarding dietary supplements have not been evaluated by the Food and Drug Administration. Dietary-supplement products are not intended to diagnose, treat, cure, or prevent any disease.

Individual responses to dietary supplements vary. TF Labs does not promise or guarantee any particular health, wellness, fitness, appearance, weight, strength, performance, or other result.

Before using a product, carefully read the entire label, Supplement Facts panel, ingredient list, allergen or facility statement, directions, and warnings. Follow the current physical product label if it differs from general Site content.

Consult an appropriate licensed healthcare professional before using any dietary supplement, especially if you:

Are pregnant, nursing, attempting to become pregnant, or under 18;
Have a medical condition, allergy, or sensitivity;
Take prescription medication, over-the-counter medication, or another supplement;
Are sensitive to caffeine or stimulants;
Are preparing for surgery or a medical procedure; or
Are uncertain whether a product is appropriate for you.

Do not exceed the labeled serving or combine products in a manner that causes you to exceed a labeled ingredient amount. Discontinue use and promptly seek appropriate medical attention if you experience a serious or unexpected reaction. In an emergency, call 911 or the appropriate emergency service.

References or links to studies concern the research described and do not necessarily establish that a finished TF Labs product will produce the same result. The existence of a study, ingredient, or research summary does not constitute FDA approval of a product or claim.

4. Product Information and Availability

We make reasonable efforts to present product descriptions, labels, ingredients, warnings, images, colors, sizes, quantities, packaging, and availability accurately. Packaging, labels, ingredient sourcing, or other product details may change. Images are illustrative and may not perfectly reflect the product delivered because of screen settings, supplier updates, or packaging revisions.

The current physical product label controls regarding ingredients, Supplement Facts, serving size, directions, and warnings. If you receive a product whose label materially conflicts with the product you ordered or the Site listing, do not use it and contact tf.labs805@gmail.com.

Products may be unavailable, discontinued, limited in quantity, or restricted from sale or shipment to certain locations. We may limit quantities or refuse a transaction when reasonably necessary to address suspected fraud, resale, legal restrictions, pricing errors, inventory limitations, safety concerns, or violations of these Terms. Any restriction will be applied in a manner consistent with applicable law.

We do not represent that every product is appropriate, lawful, or available in every jurisdiction. You are responsible for complying with lawful restrictions applicable to possession or use at the delivery destination, but this does not excuse TF Labs from its own legal duties as a seller.

5. Orders and Acceptance

Your submission of an order is an offer to purchase. An order-confirmation message acknowledges receipt but does not necessarily mean that we have accepted the order. We may verify payment, identity, address, product availability, and compliance with applicable restrictions before accepting or fulfilling an order.

An order is accepted when we send confirmation that it has entered fulfillment or has shipped, unless applicable law provides otherwise. We may cancel or decline an order before acceptance for a legitimate reason, including suspected fraud, payment failure, inventory unavailability, an obvious pricing or description error, a shipping restriction, or legal compliance.

If we cancel an order after payment has been captured, we will refund the canceled amount to the original payment method.

You agree to provide current, complete, and accurate billing, shipping, payment, and contact information. You are responsible for reviewing the product, quantity, price, shipping address, and other order details before submitting the order.

Contact us immediately if you discover an error. Changes and cancellations are not guaranteed after an order enters processing, production, or fulfillment.

We may use third-party manufacturers, fulfillment providers, payment processors, carriers, and technology providers to process and complete orders. TF Labs remains responsible for its obligations to you as required by applicable law.

6. Prices, Payments, Taxes, and Promotions

Prices are displayed in the currency shown at checkout and may change prospectively without notice. The price charged is the price displayed and accepted at checkout, subject to correction of an obvious error as permitted by law.

Applicable taxes, shipping charges, duties, and other disclosed charges will be shown before you complete the purchase when reasonably determinable.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize TF Labs and its payment providers to charge the total amount disclosed at checkout. Payment processing is subject to the terms and privacy practices of the applicable payment provider.

Discount codes, promotions, gifts, and special offers may have separate terms. Unless expressly stated otherwise, promotions:

Have no cash value;
Cannot be combined;
Apply only during the stated period; and
May be limited or withdrawn prospectively.

We will not retroactively alter a completed transaction except as required by law or agreed with you.

7. Shipping and Delivery

Shipping destinations, processing estimates, delivery estimates, address responsibilities, customs terms, and lost-package procedures are governed by our Shipping Policy at:

Delivery dates are estimates unless we expressly state in writing that a date is guaranteed.

Risk of loss and title will transfer only as provided by applicable law. Nothing in these Terms eliminates TF Labs’ responsibility for loss, damage, nonconforming goods, or other obligations that the law places on a seller.

8. Returns, Refunds, Replacements, and Cancellations

Eligibility, deadlines, evidence requirements, exclusions, return instructions, refund processing, replacements, and cancellation requests are governed by our Return, Refund & Replacement Policy at:

Because dietary supplements are ingestible products, opened or unsealed products generally cannot be accepted as voluntary returns for health and safety reasons.

This restriction does not eliminate remedies available for damaged, defective, misprinted, incorrect, recalled, unsafe, or otherwise nonconforming products, or any remedy required by law.

9. Accounts and Account Security

If the Site permits customer accounts, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

Notify us promptly at tf.labs805@gmail.com if you believe your account or payment information has been accessed without authorization.

You may not:

Impersonate another person;
Create an account using materially false information;
Access another person’s account without permission; or
Use an account to commit fraud or violate applicable law.

We may suspend or restrict an account when reasonably necessary to investigate security concerns, fraud, unlawful conduct, or a material violation of these Terms. Where appropriate, we will provide notice and an opportunity to resolve the issue.

10. Acceptable Use

You may not use the Site to:

Violate any applicable law, regulation, court order, or third-party right;
Commit or facilitate fraud, deception, identity theft, or payment abuse;
Transmit malware, malicious code, or material designed to disrupt or compromise the Site;
Probe, scan, or test vulnerabilities without written authorization;
Circumvent security, access controls, purchase limits, geographic restrictions, or fraud-prevention measures;
Scrape, harvest, copy, or use Site data through automated means except as permitted by law or with our written permission;
Interfere with another person’s access to or use of the Site;
Submit unlawful, threatening, defamatory, infringing, deceptive, or harmful content;
Use Site content or product information to create a misleading, counterfeit, or unauthorized product listing; or
Resell products in violation of applicable law or a written restriction disclosed before purchase.

We may take proportionate action to prevent or stop prohibited conduct, including restricting access, canceling affected orders, preserving relevant records, or notifying service providers or authorities when lawfully required.

11. Intellectual Property

The Site and its original content—including TF Labs names, logos, graphics, product-page designs, text, photographs, videos, compilations, and software—are owned by or licensed to TF Labs and are protected by applicable intellectual-property laws.

Subject to these Terms, TF Labs grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for personal, lawful shopping and informational purposes.

This license does not permit you to reproduce, distribute, publicly display, sell, sublicense, reverse engineer, or commercially exploit protected Site content without prior written permission, except where applicable law expressly permits the activity.

Third-party names, marks, content, studies, and product information remain the property of their respective owners. Reference to a third party does not imply sponsorship or endorsement unless expressly stated.

12. Reviews, Feedback, and User Content

If you submit a review, photograph, comment, testimonial, suggestion, or other content (“User Content”), you retain ownership of content you own.

You grant TF Labs a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute that User Content for operating and promoting TF Labs, subject to our Privacy Policy and applicable law.

This license ends when the content is deleted from our systems, except for:

Materials already lawfully used in completed publications;
Records we are legally required to retain; or
Technical backup copies retained for a limited period.

You represent that you have the necessary rights to submit the User Content and that it:

Is truthful;
Is based on your genuine experience where applicable;
Does not violate another person’s rights;
Does not conceal a material incentive;
Does not falsely describe your experience; and
Does not make unsubstantiated disease-treatment or product-performance claims.

We may moderate or remove User Content that violates these Terms, is unlawful, contains sensitive personal information, makes prohibited health claims, or is reasonably suspected to be fraudulent.

We are not required to publish every submission. We will not suppress or manipulate genuine reviews merely because they are unfavorable.

Suggestions or product ideas submitted to TF Labs are voluntary. Unless we separately agree in writing, we may use general, nonconfidential feedback without compensation or obligation, but this does not transfer ownership of your preexisting intellectual property.

13. Third-Party Services and Links

The Site may use or link to services operated by Shopify, payment processors, fulfillment providers, carriers, analytics providers, social platforms, and other third parties.

Third-party services may be governed by their own terms and privacy policies.

TF Labs does not control independent third-party websites and is not responsible for their unrelated content or practices. A link does not necessarily constitute endorsement.

This provision does not limit TF Labs’ responsibility for third parties acting as our agents or service providers where applicable law makes us responsible.

14. Privacy and Electronic Communications

Our collection, use, disclosure, and retention of personal information are described in our Privacy Policy at:

By using the Site or submitting an order, you consent to receive transactional communications electronically, including:

Order confirmations;
Receipts;
Security notices;
Policy notices;
Fulfillment and delivery updates; and
Customer-service responses.

You are responsible for keeping your email address and other contact information current.

Consent to receive marketing email or text messages is separate and voluntary. You may withdraw marketing consent through the method provided in the message or as described in the Privacy Policy.

Withdrawing marketing consent does not prevent necessary nonmarketing communications concerning an order, account, safety issue, or legal notice.

15. Errors, Omissions, and Corrections

The Site may occasionally contain typographical errors, inaccurate information, or omissions concerning product details, pricing, promotions, availability, shipping, or other matters.

We may correct errors and update information prospectively.

If an error materially affects an order you submitted, we may:

Contact you for confirmation;
Offer a lawful correction; or
Cancel and refund the affected order.

We will not use this provision to substitute a materially different product or impose a higher price after purchase without your informed agreement.

16. Disclaimer of Site Warranties

To the fullest extent permitted by law, the Site and general Site content are provided on an “as is” and “as available” basis.

TF Labs does not warrant that the Site will always be uninterrupted, error-free, secure, or free of harmful components.

This Site-level disclaimer does not eliminate:

Any express written product warranty;
A warranty arising under applicable law;
The obligation to deliver conforming goods;
A remedy for a defective or unsafe product; or
Any non-waivable consumer right.

No statement on the Site creates a guarantee of individual results. Product suitability depends on personal circumstances, proper use, compliance with the applicable label, and appropriate professional advice.

17. Limitation of Liability

To the fullest extent permitted by law, TF Labs and its officers, employees, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of—or inability to use—the Site, when such damages were not reasonably foreseeable.

Nothing in these Terms excludes or limits liability for:

Fraud or fraudulent concealment;
Willful misconduct;
Gross negligence where liability cannot lawfully be limited;
Personal injury, death, or property damage to the extent caused by a legally actionable defect, breach of duty, or other conduct for which liability cannot lawfully be limited;
Violation of a non-waivable consumer-protection right; or
Any other liability that applicable law prohibits us from excluding or limiting.

Some jurisdictions do not allow certain warranty exclusions or limitations of liability. In those jurisdictions, the provisions above apply only to the maximum extent permitted by law.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless TF Labs LLC and its officers, employees, and agents from third-party claims, losses, and reasonable costs arising from your:

Material violation of these Terms;
Fraudulent, unlawful, or intentionally harmful use of the Site;
Infringement of another person’s intellectual-property or privacy rights through User Content you submit; or
Unauthorized resale, relabeling, alteration, or misuse of a product.

This obligation does not apply to the extent a claim results from TF Labs’ own negligence, willful misconduct, legal violation, product defect, or breach of duty.

TF Labs will provide reasonable notice of a covered claim and will not agree to a settlement that imposes a nonmonetary obligation or admission on you without your consent.

19. Recalls, Safety Notices, and Regulatory Compliance

TF Labs may contact customers, suspend sales, cancel orders, issue warnings, coordinate replacements or refunds, or take other appropriate action in response to:

A product recall;
An adverse-event report;
A label correction;
A supplier notice;
A safety concern; or
A legal or regulatory requirement.

You agree not to remove, alter, conceal, or disregard product labels, lot information, expiration information, warnings, or recall notices.

If you learn that a product you possess is subject to a recall or safety notice, stop using it and follow the provided instructions.

20. Force Majeure

TF Labs is not responsible for delay or failure caused by events beyond its reasonable control, such as:

Natural disasters or severe weather;
Fire;
Epidemic;
War, terrorism, or civil unrest;
Labor disruption;
Carrier interruption;
Utility or internet failure;
Government action;
Embargo; or
Widespread supply-chain disruption.

This provision does not excuse refunds or other remedies that applicable law requires. TF Labs will make reasonable efforts to reduce the effect of the event and resume performance.

21. Suspension and Termination

You may stop using the Site at any time.

TF Labs may suspend or terminate access when reasonably necessary because of:

A material breach of these Terms;
Fraud;
A security risk;
Unlawful conduct; or
Harm to TF Labs, its customers, or third parties.

Termination does not eliminate rights or obligations that accrued before termination.

Provisions that logically should survive—including payment obligations, intellectual-property protections, disclaimers, liability provisions, indemnification, dispute provisions, and record-retention rights—will survive to the extent permitted by law.

22. Governing Law and Venue

These Terms and any dispute arising from them are governed by the laws of the State of California, without regard to conflict-of-laws principles, except where federal law controls.

Subject to any non-waivable right to bring a claim elsewhere, the parties agree that a legal action arising from these Terms may be brought in a state or federal court with jurisdiction over San Luis Obispo County, California.

Each party consents to personal jurisdiction in those courts to the extent legally permitted.

This section does not deprive a consumer of the protection of any mandatory law that applies based on the consumer’s residence or the transaction.

These Terms do not waive any right or remedy that California or other applicable law makes non-waivable.

23. Dispute Resolution

Before filing a lawsuit, you and TF Labs agree to make a good-faith effort to resolve the dispute informally, unless immediate relief is reasonably necessary or the law prohibits a pre-suit requirement.

TF Labs will review and respond within a reasonable time.

This informal process does not:

Shorten any statute of limitations;
Prevent either party from seeking emergency or injunctive relief;
Restrict a lawful chargeback or government-agency complaint; or
Require a consumer to surrender any non-waivable right.

These Terms do not require mandatory arbitration and do not contain a class-action waiver.

24. Changes to These Terms

We may revise these Terms prospectively to reflect changes in law, products, Site features, service providers, or business practices.

The revised Terms will state a new effective date and will be posted on the Site.

Material changes will not retroactively alter the essential terms of a completed purchase unless you agree or applicable law requires the change. If law requires additional notice or consent, we will provide it.

Your continued use of the Site after revised Terms become effective constitutes acceptance of those revised Terms for future use.

25. General Provisions

Severability. If a court finds a provision unenforceable, that provision will be enforced to the maximum lawful extent or severed, and the remainder will continue in effect.

No Waiver. A failure to enforce a provision is not a waiver of the right to enforce it later.

Assignment. You may not assign these Terms without our written consent. TF Labs may assign these Terms in connection with a merger, acquisition, asset sale, financing, reorganization, or transfer of the Site or business, provided the assignment does not reduce non-waivable consumer rights. Any other assignment by TF Labs will be made only as permitted by law.

Headings. Headings are for convenience and do not change the meaning of these Terms.

Entire Agreement. These Terms, the policies incorporated above, product-specific disclosures, and terms presented and accepted at checkout form the entire agreement concerning the applicable use or transaction and supersede earlier inconsistent statements concerning that subject.

No Third-Party Beneficiaries. Except where these Terms expressly provide otherwise, they do not create rights in a person who is not a party to them.
